- Durchführung des Story Quiz Instagram-Gewinnspiels, Geltungsbereich der Teilnahmebedingungen, Einverständnis
1.1 Veranstalter des Instagram-Gewinnspiels Story Quiz ist die (ESBT GmbH (nachstehen: „ESBT“), E-Mail: info@esbt.one. Die Teilnahme an dem Story Quiz und dessen Durchführung richten sich nach den folgenden Bestimmungen.
1.2 Das Story Quiz steht in keiner Verbindung zu Instagram oder einem mit Instagram verbundenen Unternehmen. Er wird in keiner Weise von Instagram gesponsert, unterstützt oder organisiert. Ansprechpartner und verantwortlich für Planung, Organisation und Durchführung des Fotowettbewerbs und Herausgeben der Gewinne ist in keiner Weise Instagram, sondern ausschließlich die ESBT. Teilnehmer*innen können gegenüber Instagram keine Ansprüche geltend machen, die im Zusammenhang mit der Teilnahme an der Aktion entstehen.
1.3 Durch Ihre Teilnahme an dem Story Quiz bestätigen Sie, dass
- Sie sich mit diesen Teilnahmebedingungen einverstanden erklären,
- Sie damit einverstanden sind, dass Ihr Instagram-Accounts im Rahmen des Story Quiz sowie der hiermit zusammenhängenden Berichterstattung zu redaktionellen und werblichen Zwecken auf den digitalen Plattformen von Hirzl AG und ihrer Vertriebspartner veröffentlicht wird.
1.5 Die ESBT behält sich vor, die Teilnahmebedingungen jederzeit mit Wirkung für die Zukunft zu ändern oder anzupassen. In diesem Fall werden die Teilnehmer*innen hierüber an geeigneter Stelle auf dem „hirzl_gloves“ Instagram-Account informiert.
- Teilnahmevoraussetzungen, Teilnahme an der Fotoaktion, Ausschlussmöglichkeit
2.1 Teilnahmeberechtigt sind alle natürlichen Personen, die das 18. Lebensjahr vollendet haben und ihren Wohnsitz in der EU haben. Mitarbeiter*innen sowie gesponserte Vereine oder Personen des Veranstalters sowie der HIRZL AG und der mit diesen im Sinne von §15 AktG verbundenen Unternehmen sind nicht zur Teilnahme an dem Story Quiz Gewinnspiel berechtigt.
2.2 Die Teilnahme setzt voraus, dass die Teilnehmer*innen einen Instagram-Account betreiben und hirzl_gloves folgen.
2.3 Die Aufgabenstellung des Story Quiz wird auf dem „hirzl_gloves“ Instagram-Account ausschließlich in der Story(https://www.instagram.com/hirzl_gloves/) beschrieben. Dabei müssen die Teilnehmer*innen im Gewinnspielzeitraum eine Zahlen Kombination aus den Antworten der gestellten Quizfragen gewinnen und diese dann per Privatnachricht auf Instagram an hirzl_gloves senden.
2.4 Texte müssen die gestellte Aufgabe erfüllen und dürfen nicht gegen gesetzliche Vorschriften, Rechte Dritter, die öffentliche Ordnung, die guten Sitten und/oder diese Teilnahmebedingungen verstoßen.
2.5 Die Teilnahme an dem Story Quiz ist kostenlos. Mehrfachteilnahme ist nicht zulässig. Gewinnspielberechtigt sind Antworten, die im Gewinnspielzeitraum an hirzl_gloves per Privatnachricht übermittelt werden und die Aufgabenstellung aus 2.3. erfüllen.
2.6 Die ESBT behält sich vor, Teilnehmer*innen, bei denen der Verdacht besteht, dass sie gegen diese Teilnahmebedingungen verstoßen oder die Aktion manipulieren, jederzeit und ohne Vorankündigung von der Teilnahme auszuschließen und gegebenenfalls auch nachträglich Gewinne abzuerkennen und zurückzufordern. Zum Ausschluss führt weiterhin die mehrfache Teilnahme mit unterschiedlichen Instagram-Accounts sowie mit unwahren Personenangaben
Die ESBT weist ferner darauf hin, dass etwaige Vorwürfe der Benachteiligung von Teilnehmenden durch andere Teilnehmer*innen/Nutzer*innen nicht durch die ESBT, sondern zwischen den Betreffenden zu klären sind.
- Aktionszeitraum, Ermittlung des Gewinners und Abwicklung
3.1 Der Beantwortung ist nur möglich, während die Instagram Story live ist. Die ersten 3 Instagram Privatnachrichten mit korrekter Lösung, die hirzl_gloves unter allen berechtigten Nachrichten als erstes erreicht, ist die gewinnende.
Es gibt nur drei Gewinner.
3.2 Das so ermittelte Ergebnis ist endgültig und bindend. Der Rechtsweg ist ausgeschlossen.
3.3 Die Gewinner*innen werde innerhalb 25 Tage nach Beendigung des jeweiligen Monats durch die ESBT auf dem @hirzl_gloves Instagram-Account in der Story markiert. Zugleich werden die Gewinner*innen per Direktnachricht („Direct Message“) über Instagram benachrichtigt und über die weitere Gewinnabwicklung informiert. Bestätigt der*die Gewinner*in die Annahme des Gewinns nicht innerhalb einer Frist von 14 Tagen nach Benachrichtigung unter Angabe seiner vollständigen Kontaktadresse, wird die ESBT ihn*sie erneut kontaktieren und eine angemessene Frist zur Annahme/Inanspruchnahme setzen. Erfolgt daraufhin keine Erklärung des*r Gewinners*in innerhalb der Frist, so entfällt der Gewinnanspruch ersatzlos und es wird ein*e Ersatzgewinner*in ermittelt.
3.4 Sofern in der Gewinnbeschreibung oder -benachrichtigung nicht anders angegeben, erfolgt der Versand des Gewinns nach Beendigung des Fotowettbewerbs per Post an die von dem*r Gewinner*in angegebene Adresse. Falls die von dem*r Gewinner*in angegebene Adresse unrichtig ist und/oder der Gewinn aus sonstigen Gründen nicht übergeben werden kann, die der*die Gewinner*in zu vertreten hat, entfällt der Gewinnanspruch.
- Gewinn
4.1 Unter allen Teilnehmenden verlost ESBT insgesamt drei Hirzl Golf- Handschuh nach freier Wahl, vorausgesetzt dieser ist in Farbe und Größe verfügbar. Der Gewinn beinhaltet ausschließlich die in der Gewinnbeschreibung ausgelobten Bestandteile.
4.2 Der Gewinn ist nicht übertragbar. Eine Barauszahlung, Änderung oder ein Tausch des Gewinns ist nicht möglich. Ein nicht bis zum jeweils genannten Einlösetermin in Anspruch genommener Gewinn verfällt.
- Haftungsbeschränkungen
5.1 Die ESBT übernimmt keine Garantie oder Gewähr für die Verfügbarkeit und Funktion der Internetseite www.esbt.one. bzw. des „hirzl_gloves“ Instagram-Accounts oder der darauf eingestellten Inhalte im Zusammenhang mit dem Story Quiz. Insbesondere nicht dafür, dass Fotos und Daten aufgrund technischen oder menschlichen
Versagens gelöscht oder beschädigt werden oder verloren gehen. Die ESBT behält sich vor, das Story Quiz (auch ohne vorherige Ankündigung) ganz oder teilweise einzustellen oder den Zugang hierzu ganz oder teilweise einzuschränken, ohne dass hieraus Ansprüche der Teilnehmer*innen gegenüber der ESBT entstehen.
- Datennutzung
6.1 Die ESBT speichert und verarbeitet personenbezogene Daten im erforderlichen Umfang ausschließlich zur Abwicklung und Durchführung des Story Quiz und Gewinnabwicklung inkl. Dem Versand durch ein externes Lager und einen entsprechenden Versanddienstleister gemäß den Bestimmungen des Datenschutzgrundverordnung. Eine Weitergabe an Dritte erfolgt nicht.
6.2 Empfänger der von den Teilnehmern*innen bereitgestellten Daten/Informationen ist in keiner Weise Instagram, sondern ausschließlich die ESBT.
6.3 Jede*r Teilnehmer*in kann jederzeit Auskunft über seine*ihre bei der ESBT gespeicherten personenbezogenen Daten erhalten sowie deren Berichtigung, Löschung oder Sperrung verlangen. Sollte er*sie im Nachhinein Einwände gegen die Speicherung, Verarbeitung und Nutzung seiner Daten haben, kann er*sie seine*ihre Einwilligung jederzeit ohne Angabe von Gründen bei der ESBT widerrufen. Der Widerruf muss schriftlich erfolgen, wahlweise per E-Mail an info@esbt.one oder per Post an ESBT GmbH, Marktplatz 6, 88316 Isny i.A. Deutschland
6.4 Soweit im Rahmen des Gewinnspiels Funktionen von Instagram genutzt werden (z.B. Direct Message) erfolgt die Datennutzung im Rahmen der Instagram Datenschutz- und Nutzungsbedingungen.
Sonstiges
7.1 Diese Teilnahmebedingungen sowie die gesamte Rechtsbeziehung zwischen dem*r Teilnehmer*in und ESBT unterliegen dem Recht der Bundesrepublik Deutschland mit Ausnahme seiner kollisionsrechtlichen Bestimmungen.
7.2 Sollte eine Bestimmung dieser Teilnahmebedingungen ungültig sein oder werden, so bleibt die Wirksamkeit der übrigen Bedingungen davon unberührt.

Terms and Conditions for Instagram Story Quiz Contest
- Conduct of the Story Quiz Instagram Contest, Scope of the Terms and Conditions, Consent
1.1 The organizer of the Instagram Story Quiz Contest is ESBT GmbH (hereinafter referred to as “ESBT”), email: info@esbt.one. Participation in the Story Quiz and its implementation are governed by the following provisions.
1.2 The Story Quiz is not affiliated with Instagram or any company associated with Instagram. It is in no way sponsored, supported, or organized by Instagram. The contact person and party responsible for planning, organizing, and conducting the photo contest and awarding the prizes is in no way Instagram, but exclusively ESBT. Participants cannot assert any claims against Instagram in connection with their participation in the contest.
1.3 By participating in the Story Quiz, you confirm that
- you agree to these terms and conditions of participation,
- you agree that your Instagram accounts may be published on the digital platforms of Hirzl AG and its distribution partners for editorial and advertising purposes in connection with the Story Quiz and related reporting.
1.5 ESBT reserves the right to change or adapt the terms and conditions of participation at any time with future effect. In this case, participants will be informed of this at a suitable location on the “hirzl_gloves” Instagram account.
- Eligibility requirements, participation in the photo campaign, possibility of exclusion
2.1 All natural persons who are at least 18 years of age and reside in the EU are eligible to participate. Employees and sponsored clubs or persons of the organizer and HIRZL AG and companies affiliated with them within the meaning of §15 AktG (German Stock Corporation Act) are not eligible to participate in the Story Quiz competition.
2.2 Participation requires that participants have an Instagram account and follow hirzl_gloves.
2.3 The Story Quiz task is described exclusively in the story (https://www.instagram.com/hirzl_gloves/) on the “hirzl_gloves” Instagram account. During the contest period, participants must enter a combination of numbers from the

2.4 Entries must fulfill the task set and must not violate any legal regulations, third-party rights, public order, morality, and/or these terms and conditions.
2.5 Participation in the Story Quiz is free of charge. Multiple entries are not permitted. Answers that are sent to hirzl_gloves via private message during the competition period and that fulfill the task specified in 2.3 are eligible for the competition.
2.6 ESBT reserves the right to exclude participants who are suspected of violating these conditions of participation or manipulating the promotion at any time and without prior notice, and, if necessary, to subsequently revoke and reclaim prizes. Multiple entries using different Instagram accounts or false personal details will also result in exclusion.
ESBT also points out that any allegations of discrimination against participants by other participants/users are not to be clarified by ESBT, but between the parties concerned.
- Promotion period, determination of the winner, and processing
3.1 Responses can only be submitted while the Instagram Story is live. The first 3 Instagram private messages with the correct answer that hirzl_gloves receives among all eligible messages will be the winners.
There will only be three winners.
3.2 The result determined in this way is final and binding. Legal recourse is excluded.
3.3 The winners will be tagged by ESBT in the story on the @hirzl_gloves Instagram account within 25 days of the end of the respective month. At the same time, the winners will be notified via direct message on Instagram and informed about the further processing of the prize. If the winner does not confirm acceptance of the prize within 14 days of notification, providing their full contact address, ESBT will contact them again and set a reasonable deadline for acceptance/claim. If the winner does not respond within the deadline, the prize claim will be forfeited without replacement and a substitute winner will be determined.
3.4 Unless otherwise stated in the prize description or notification, the prize will be sent by mail to the address provided by the winner after the photo contest has ended. If the address provided by the winner is incorrect and/or the prize cannot be delivered for other reasons for which the winner is responsible, the prize claim shall lapse.
4.1 ESBT will raffle off a total of three Hirzl golf gloves of the winner’s choice among all participants, provided that the glove is available in the desired color and size. The prize includes only the components specified in the prize description.
4.2 The prize is non-transferable. Cash payment, modification, or exchange of the prize is not possible. Any prize not claimed by the specified redemption date will be forfeited.
- Limitations of liability
5.1 ESBT does not guarantee or warrant the availability and functionality of the website www.esbt.one or the “hirzl_gloves” Instagram account or the content posted on it in connection with the Story Quiz. In particular, ESBT does not guarantee that photos and data will not be deleted, damaged, or lost due to technical or human error.
ESBT reserves the right to discontinue the Story Quiz in whole or in part (even without prior notice) or to restrict access to it in whole or in part, without this giving rise to any claims by participants against ESBT.
- Data usage
6.1 ESBT stores and processes personal data to the extent necessary exclusively for the purpose of conducting and implementing the Story Quiz and prize processing, including shipping by an external warehouse and a corresponding shipping service provider in accordance with the provisions of the General Data Protection Regulation. No data will be passed on to third parties.
6.2 The recipient of the data/information provided by the participants is in no way Instagram, but exclusively ESBT.
6.3 Each participant may at any time obtain information about their personal data stored by ESBT and request its correction, deletion, or blocking. If they subsequently object to the storage, processing, and use of their data, they may revoke their consent at any time without giving reasons to ESBT. The revocation must be made in writing, either by email to info@esbt.one or by post to ESBT GmbH, Marktplatz 6, 88316 Isny i.A., Germany.
6.4 Insofar as Instagram functions are used within the framework of the competition (e.g., direct message), data use is subject to Instagram’s privacy policy and terms of use.
Miscellaneous
7.1 These conditions of participation and the entire legal relationship between the participant and ESBT are subject to the laws of the Federal Republic of Germany, with the exception of its conflict of law provisions.
7.2 Should any provision of these conditions of participation be or become invalid, the validity of the remaining provisions shall remain unaffected.
